Description of Services
Keryx enables human-initiated outbound calls and manual voicemail delivery. We are not a telecom carrier.
These Terms of Service (“Terms”) govern access to and use of the Keryx platform (“Keryx,” “Company,” “we,” “us,” or “our”). By creating an account or using the Services, you agree to these Terms.
Keryx provides software that enables users to initiate outbound voice calls and, when manually selected by the user, deliver prerecorded voicemail messages. Keryx does not originate calls independently and does not act as a telecommunications carrier.
All calls and voicemail messages are initiated solely at the direction of the Customer.
Human-Initiated Use Requirement
Every call and voicemail must be manually initiated. No automated, predictive, or bulk dialing.
Compliance With Laws
You are responsible for complying with TCPA, FCC, FTC, DNC, and all state telemarketing laws.
Prerecorded and AI-Generated Voice Messages
Voicemails may constitute prerecorded voice communications. You must have consent to deliver them.
Prohibited Uses
No political calls, debt collection, scams, harassment, or use of scraped lead lists.
Indemnification
You agree to defend and hold Keryx harmless from claims related to your calling activity.
Suspension and Termination
We may suspend or terminate accounts for abuse, complaints, or Terms violations.
Limitation of Liability
Liability capped at 12 months of fees. No indirect or consequential damages.
No Warranties
Services provided 'as is'. No guarantees on call delivery, answer rates, or compliance.
Data and Privacy
We collect call metadata and usage data to operate the platform. See our Privacy Policy.
Governing Law
These Terms are governed by the laws of the State of Delaware.
Modifications
We may update these Terms at any time. Continued use constitutes acceptance.
